Domestic Violence

If you are arrested for domestic violence you can expect to be booked into custody, served with a restraining order that prevents you from returning to your home, prevents you from speaking to your partner, makes it illegal to communicate in any way with your partner and possibly your children and the restraining order will make it illegal for you to possess, own or be in custody of any firearms.

Most law enforcement agencies will arrest and book someone when a report of domestic violence comes in.  They have policies in place to protect themselves at the expense of your personal liberty and your rights.  If you are arrested and served with a restraining order simply making a phone call to your partner will be enough to file a new criminal charge against you.  Contacting your children could be enough to file new charges against you and even asking someone you know to send a message to your children or your partner could be enough to file new charges against you.

A charge of domestic violence can have significant implications and major impacts upon your life.  The Federal government could eliminate your right to firearms for the rest of your life.  You could be forced to leave your home, go to domestic violence counseling classes for a year, be under supervised probation, have your home, car and person searched without probable cause for years

Drug Charges

If you are charged with possession of drugs, possession of drugs with the intent to sell or transportation of drugs you need an experienced attorney to protect your rights.  The District Attorney's office will find a police office who will testify that based on the amount of drugs you allegedly had you intended to sell those drugs.  Even if the amount is small they will testify that because you had drugs and cash that is proof you were selling drugs.

Your cell phone and any digital devices you had with you will be seized and searched.  All your social media accounts, text messages and phone calls will be searched.

Weapons Charges

Sam has over a decade of experience dealing with weapons charges against individuals, both on the felony and misdemeanor level.  Concealed dirk or dagger charges can include a fixed blade knife in a sheath worn openly on your belt but if your shirt or coat accidently covers it the district attorney can charge you with a felony.  If you have certain prior convictions or even a restraining order the possession of some items can be charged as a felony.
